Terms & Conditions
The agreement between you and The Forever Note when you use this website or buy a gift.
1. Who we are
The Forever Note is operated by John Henry Herbst (sole proprietor) (Not registered — trading as a sole proprietor), South Africa. “We”, “us” and “our” mean The Forever Note; “you” means the person using the site or placing an order.
2. What we sell
A personalised gift page — a web page built from the recipient name, message, photos and optional song you provide, which we host and make available at a private link. Some tiers also include a physical card (NFC and/or QR) that opens the same page.
3. The “forever” promise — and its limits
We intend to keep every gift page online indefinitely, and the hosting cost is built into the price. That said, we may remove or disable a page if:
- we are required to by law or a valid legal request;
- it breaches the acceptable-use rules in section 5;
- the business genuinely cannot continue to operate — in which case we will give reasonable advance notice by email (where we have one) and, where practical, a way to export the page content.
4. Links and access
Recipients need no account. A gift page is reachable only by its private link (and the card). Treat the link as confidential — anyone who has it can view the page. We are not responsible for a page being seen by someone you shared the link with.
5. Your content
- You keep ownership of everything you upload — photos, text and audio.
- You grant us a non-exclusive licence to store, process, display and (for physical tiers) print that content, solely to provide the service to you.
- You confirm that you own or have permission to use the content, and that you are entitled to share the recipient’s (and any other person’s) personal information with us for this purpose.
- Music: if you paste a YouTube or Spotify link we only embed the platform player — we do not host the track. If you upload an audio file, you confirm it is your own recording or one you are licensed to use.
- Not allowed: anything unlawful, infringing, hateful, harassing or defamatory; sexual content involving minors; content that invades someone’s privacy; malware; or another person’s photos or music used without permission.
- We may remove content or a page that breaches these rules, and may report clearly unlawful content to the authorities.
6. Prices and payment
Prices are in South African Rand and include hosting. The price and any delivery fee are shown at checkout. Payment is processed by Yoco; your order is confirmed only once Yoco tells us the payment has cleared. If payment does not complete, no gift page is issued.
7. Delivery
- Digital tier: the private link and QR code are shown on the order confirmation and, where you provide an email address, sent to you.
- Physical tiers: the card is dispatched via Pargo, PUDO or Aramex, as selected at checkout. Delivery timeframes are estimates, not guarantees. Risk in the card passes to you on delivery to you or your chosen pickup point.
8. Getting it right
You are responsible for what you enter — check the live preview before you pay. After payment, your order confirmation includes an “Edit this page” link: you can change the page’s content yourself up to five times. While a physical card is still being prepared you can also send us the exact name to print from the order page. See the Refund & Cancellation Policy.
9. Availability
We aim for high availability but do not guarantee that the site or any page will be uninterrupted or error-free. We may carry out maintenance that briefly takes pages offline.
10. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including under the Consumer Protection Act, 2008. Subject to that:
- we are not liable for indirect or consequential loss, or for loss of data or profit;
- our total liability for any order is limited to the amount you paid for that order.
11. Consumer Protection Act
Where the Consumer Protection Act applies, it prevails over anything inconsistent in these terms. These terms do not limit your statutory rights.
12. Changes
We may change the service or these terms. The current version is dated at the foot of the page; continuing to use the site after a change means you accept the updated terms.
13. Governing law
These terms are governed by the law of South Africa. Please raise any dispute with us first at forevernoteza@gmail.com; unresolved disputes are subject to the jurisdiction of the South African courts.
